Terms of Use

2.1 Eligibility: You must be at least 18 years old to create an account and use our Services. By registering, you represent and warrant that you meet this age requirement.

2.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3 Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

2.4 Beta Access: During our beta period, access may be limited to a specific number of users. We reserve the right to manage registration through a waiting list system.

3.1 AI-Powered Conversion: BardVoice provides AI-powered audiobook generation services that convert your uploaded e-books, documents, and text content into audiobooks using advanced text-to-speech technology.

3.2 Supported Formats: We currently support TXT, PDF, EPUB, MOBI, AZW, and AZW3 file formats. File size is limited to 15MB per upload.

3.3 Voice Options: Our Services offer multiple AI-generated voices for narration, including specialized character voices for theatrical storytelling.

3.4 Service Availability: While we strive to provide uninterrupted service, we do not guarantee that the Services will be available at all times. We may modify, suspend, or discontinue any aspect of the Services at any time.

4.1 Your Content: You retain all ownership rights to the content you upload to BardVoice ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to process, store, and convert your content for the purpose of providing our Services.

4.2 Copyright Compliance: You represent and warrant that you own or have the necessary rights, licenses, and permissions to upload and convert any User Content. You must not upload content that infringes on any third party's intellectual property rights.

4.3 Prohibited Content: You agree not to upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

4.4 Generated Audiobooks: The audiobooks generated from your User Content are for your personal use only. You may not distribute, sell, or commercially exploit the generated audiobooks without proper authorization.

4.5 Content Removal: We reserve the right to remove any User Content that violates these Terms or applicable laws, or for any other reason at our sole discretion.

5.1 Daily Quota: Each user account is subject to a daily conversion quota of 200,000 characters. This quota resets every 24 hours.

5.2 Fair Use: You agree to use the Services in accordance with fair use principles. We reserve the right to impose additional limitations or suspend accounts that engage in excessive or abusive usage.

5.3 Storage Limits: Generated audiobooks and uploaded content may be subject to storage limitations. We reserve the right to delete content that has not been accessed for an extended period.

6.1 Free Beta Access: During our beta period, certain features may be available free of charge. We reserve the right to introduce paid subscription plans in the future.

6.2 Future Pricing: If we introduce paid plans, we will provide advance notice. Continued use of paid features after such notice constitutes acceptance of the pricing terms.

6.3 Refund Policy: Refund policies for any future paid services will be clearly stated at the time of purchase.

You agree not to:

• Use the Services for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Services or servers or networks connected to the Services
• Use any automated means to access the Services or collect information from the Services
• Reverse engineer, decompile, or disassemble any aspect of the Services
• Upload viruses, malware, or any other malicious code
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Sell, resell, or commercially exploit the Services without our express written permission
• Use the Services to generate content that violates intellectual property rights

8.1 Our Rights: The Services, including all content, features, functionality, software, and technology, are owned by BardVoice and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use, subject to these Terms.

8.3 Trademarks: BardVoice, our logo, and other marks are trademarks of BardVoice. You may not use these marks without our prior written permission.

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our privacy practices as described in the Privacy Policy.

10.1 "AS IS" Basis: THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 AI-Generated Content: We do not guarantee the accuracy, quality, or suitability of AI-generated audiobooks. The quality of generated audio may vary depending on the source content and selected voice options.

10.3 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARDVOICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10.4 Maximum Liability: Our total liability to you for all claims arising from or relating to the Services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 if you have not made any payments.

You agree to indemnify, defend, and hold harmless BardVoice, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Services
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

12.1 By You: You may terminate your account at any time by contacting our support team or using the account deletion feature in your settings.

12.2 By Us: We may suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

12.3 Effect of Termination: Upon termination, your right to use the Services will immediately cease. We may delete your User Content and generated audiobooks, though we are not obligated to do so.

13.1 Informal Resolution: If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally.

13.2 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BardVoice operates, without regard to its conflict of law provisions.

13.3 Arbitration: Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.

14.1 Entire Agreement: These Terms constitute the entire agreement between you and BardVoice regarding the Services and supersede all prior agreements.

14.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.5 Modifications: We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date.
